A few days after the head of Samsung's mobile division told The Sydney Morning Herald that Apple's attempts to ban the Galaxy Tab 10.1 in Australia has made the tablet a "household name", Samsung unveiled numerous Galaxy smartphone commercials that poked fun at Apple fanatics.

From that, it is quite clear that the Korean manufacturer will be celebrating over their recent victory over Apple; and what better way to do so than posting advertisements displaying Apple as 'unethical' on one of the most popular newspapers in the country!
"At the end of the day the media awareness certainly made the Galaxy Tab 10.1 a household name compared to probably what it would've been based on the investment that we would've put into it from a marketing perspective," said Typer McGee, Samsung Australia vice president of telecommunications.
Right you are! Thousands of articles have been written this year about the Samsung/Apple lawsuit(s), and the press coverage has definitely boosted sales. This year, it was reported by Lenovo that Samsung had only sold 20,000 of its Galaxy Tabs between its release in September last year to the end of 2010, thats about 5,000 sold every month. According to IDC Samsung had sold just over 1 million units between July to the end of September, thats about 336,000 sold every month. In that same time period Google shows that the rate of news about the Apple/Samsung lawsuit(s) was at its peak.

After suing nearly every popular android smartphone manufacturer, Apple is currently getting a taste of its own medicine.

U.S. company, Cequint claims that Apple is infringing two patents for caller- identification technology. Cequint has presented the following patents, 7,200,212 and 6,353,664 that "identifies a calling party's telephone number, household name, and city and/or state location".

Like me, you have probably have never heard of Cequint, but their Enhanced Caller ID can be found in U.S. Cellular's City ID and T-Mobile’s Name ID. Also Cequint's partners (listed on its website) are AT&T, Alltel, U.S. Cellular, Qualcomm, Casio, LG, Huawei, RIM, Sony, Casio, HTC, Motorola, Nokia, Google, and Samsung.

According to Bloomberg, The case will be held in the U.S. District Court, District of Delaware (Wilmington).

This is the forth case concerning Apple's Caller ID, just a few months ago Classco had sued Apple, HTC, RIM, HP and Samsung over caller ID patent infringements and back in 2008, and Romek Figa sued Nokia with the Finnish manufacturer winning the case and receiving royalties.

Buried several levels deep within the Terms and conditions of your Angry Birds or Cut the Rope app may be a column that states that the app is able to send text messages resulting in premium SMS toll rates.

While in the app, users are unaware that the app is actually sending dozens of premium SMS messages, costing them $5 each! The person behind all of this mayhem is an Italian developer going under the name of, "Lagostrod", who within a space of a day had made $6,500, from the "SMS Trojan".

The Trojan targeted users in Europe, specifically from Russia, Azerbaijan, Armenia, Georgia, Czech Republic, Poland, Kazakhstan, Belarus, Latvia, Kyrgyzstan, Tajikistan, Ukraine, Estonia as well as Great Britain, Italy, Israel, France, Great Britain, and Germany.

After dozens of complaints from users, Google has finally pulled all 18 of Lagostod's malicious applications from the Android Market. Hours after Lagostod's account was suspended, a developer named “Miriada Production” released many of the same Trojanized apps, it has since been removed. Next time when your downloading a popular application make sure to take a glance over the terms or conditions or at least look to see if the developer is in fact Rovio!

Apple has lost a court battle over the trademark of the word 'iPad' in China.

The company has been part of an ongoing legal battle with Hong Kong-based manufacturer, Proview since 2006, over claims by Proview that Apple had unwittingly purchased their trademark. Proview has owned the trademark since the start of 2000, but Apple had indeed purchased the $54,000 trademark but didn't buy the rights to the Chinese trademark in the agreement, just in the Taiwanese region. It is reportered that Proview will claim $1.6 billion in compensation from Apple for copyright infringement.

In 2001 LG introduced a linux-based tablet called the iPad in Korea! Several articles from numerous websites covered it from the 2001 CeBIT. Once again we find ourselves saying, "Why isn't LG suing". Although this isn't the first time that Apple has used other people's trademarks without their permission. In 1998, Cicsco Sytems introduced the iPhone, a phone using voiP technology, nine years later Apple came out with their first phone, iPhone (stylized the same).

The lawsuit between smartphone rivals, Samsung and Apple started earlier this year and finally its starting to draw to a close. Apple claims that the design on various Samsung phones infringed about half a dozen of their patents, but Samsung insists that Apple is trying to remove all of its competitors of the market.
In order to disprove Samsung’s claim, Apple needed to provide alternate design options to prove that Samsung had "blatantly copied the iPhone's design". Some samples from these suggestions include:
  • Front surface that isn't black.
  • Overall shape that isn't rectangular, or doesn't have rounded corners.
  • Display screens that aren't centered on the front face and have substantial lateral borders.
  • Non-horizontal speaker slots.
  • Front surfaces with substantial adornment.
  • No front bezel at all.
This along with the doctored comparisons between the iPhone 3Gs and the Samsung Galaxy SII and Apple's hypercritical claim that Motorola [Mobility] had been using its patents to "Eliminate competing alternative technologies"; has made the most valuable company look very foolish.
If Samsung were to comply with Apple's alternative design options we would get something like this:

After Samsung had failed to uplift the band in the Netherlands, I wasn't hopeful that the Samsung Galaxy tab 10.1 would be available in Australia any time soon. Although an Australia federal court on Wednesday uplifted the ban, and the tab will be available to purchase Next Friday. The Galaxy Tab was banned in Australia due to its multi-touch features being too similar to Apple's, while in the Netherlands the tablet was banned due to its design, where Apple showed Doctored Comparisons between the Galaxy Tab and the iPad.

A majority of our technology is from China, it may say "Designed in America" or "Packaged in Britain" but most likely it has been made in Asia. Where employees work almost 12 hours a day, (including over-time) and are paid a mere $1 per hour. They are subjected to a high rate of workplace injuries, mass layoffs of older staff, lack of benefits and abusive treatment by bosses.

Around 1,000 Chinese workers at Jingmo Electronics, a plant that manufacturers components for Apple, as-well as IBM dropped their tools this week to protest against enforced over-time and work conditions.

The workers had been urged to sign a "anti-suicide" pledge promising that they won't kill themselves and to "Treasure their lives", after a series of employee deaths the year prior.

"The China Labour Watch (CLW) calls upon Apple, IBM and the other clients of this factory to assume responsibility for these workers’ dissatisfaction and work with the factory to improve the working conditions in the factory" - China Labour Watch (CLW)

Earlier this year it was reported that 17 factory workers from another plant (Foxconn), had taken their lives, jumping off the plants roof. One of those jumpers left a note explaining that he committed suicide to provide for his family, the program of remuneration for the families of jumpers was then immediately canceled. After the 11th suicide Foxconn decided to skirt every building with nets.
Foxconn's and its close business partner, Apple defended the factory conditions but failed to explain the 17 deaths. Apple confirmed that workers were working approximately 8.6 hours everyday and claimed that their were “no instances of forced overtime”.

No one really cares where their technology comes from, they just want it. I trust the giant organisations that are Apple and IBM to sweep all of this mayhem in China under the carpet and pretend like it never happened.

Just clarify, 17 out of 400,000 people is much lower than the national average of roughly 88 out of 400,000 people per year, but 17 people in one workplace is huge.

A recent Samsung Galaxy S II advertisement has been given a substantial amount of press coverage, due to its mocking of [Apple] Fanatics who wait infront of the store for hours to get their hands on a new piece of technology.

The Samsung advertisement portrays a huge cue infront of an unknown store, (the cue of people having iPhones), and a white poster that is titled, "It's Coming", plastered on the side of a unknown store. The people in the cue start to notice a person with a new Samsung phone, and start commenting on its capabilities compared to the iPhones. At the end of the commercial people in the cue are then questioning their purchase, "This thing is huge" , "Its got 4G speed".

The advertisement is receiving hate from people saying its "unprofessional" and "undignified" for making fun out of other companies, probably the same people who stand overnight infront of the Apple store. The same people who probably haven't watched Apple's "Hi I'm a Mac and I'm a PC" commercials.

According to Mashable, the commercial will be broadcasted on TV on Thanksgiving.

When the Windows phone 7 was released last year and I must admit I didn't think highly of the new Windows phone. It didn't have many features that most phones on the market could do, (multitasking, copy and paste, etc). But after an update was announced that brought the phone up to date with its Android and i0S competitors, I started to realize that it could be a worthwhile competitor.

I want to begin at the range of applications that are available for a Windows phone 7 device, as this is the selling point for most phones. The Windows phone market was only released a year ago, so to be fair I couldn't compare it to the Android store or Apple App Store, which were released 3 years ago. But I can say that the Windows phone 7 is already 40,000 applications high and apps are being added at a rate of 165 items per day. At this rate it could reach 50,000 items before the end of the year.

LG, Samsung, Asus, HTC, Dell, ZTE and recently Nokia have released a touchscreen phones that are running the new mobile platform. Now thanks to recent low-budget Windows phones from Samsung and Nokia, its now more affordable to get one. Windows phone 7 devices start outright at $500 to about $800.

Do I recommend Windows Phone 7? At the moment no I don't, but just wait next year when cheaper Windows phones have been promised to come out and by then there will be a wider range of Apps available on the market.

According to Garna, Samsung is now the No. 1 smartphone manufacturer world-wide, from its very successful, wide-range, Galaxy line-up. Along with the great success from other Android manufactures such as: LG, HTC, ZTE, Motorola and Sony have given Android a 53% Smartphone market share and increased the Smartphone Sales by nearly 42%.

Modern Warfare 3 was released only five days ago, (Nov. 8), but has sold over 6.5 million copies and has grossed more than $775 million world-wide. It has beaten the first 5 day sales record, previously held by last year's Call of Duty: Black Ops, which had sold $650 million copies.

In France, according to French reports, 2 armed robbers stole 2 trucks containing thousands of copies of the game; worth a total of $1 million. The thugs were reportedly subdued with tear gas and threatened with a handgun.

To date the Call of Duty series has sold over $6 billion world-wide.

While I was away for 2 months, many things have happened between these two huge manufactures in Australia.

At the moment Samsung is wanting the iPhone 4S to be band in Australia. After Apple had stopped the shipment of their Galaxy tablets to Australian retailers, due to infringing 2 of their Touch Screen manufacturing techniques, including "How the device corrects a user's finger gesturers". Samsung is claiming that the new iPhone 4S is infringing 3 of its wireless patients, but is postponing its iPhone application until March or at latest, April 2012.

From the amount of Apple stories I post weekly, I'm surprised I haven't changed "Tech News Reporter" to "Apple News Reporter". My posts were planned to be daily, but the past 16 or so days I've been slack, and court up in other work. I am typing this post now to inform you that regular posting will commence in a week or so.

Sorry for the slow posting! I'll try to make it up to you!

"Yes, this is the same Apple that has initiated a patent war [1][2][3][4][5] with these smartphone rivals. And it's the same rival that has tried to remove competing products from the market, rather than agree to negotiate a licensing fee. And it's the same company that patented multi-touch gestures 26 years after they were invented at a research university. And it's the same company that allegedly doctored evidence in European courts [1][2] to support its lawsuits against Android." - James Mick [Daily Tech]

Apple says that they are sick of the counter lawsuits that Android manufacturers are making against them. "By making false commitments that led to the establishment of worldwide standards incorporating its own patents and eliminating competing alternative technologies. Motorola [Mobility] has become a gatekeeper, accruing the power to harm or eliminate competition in the relevant markets if it so desires." This quote was said from Apple's lawyers from the recent lawsuit against Motorola/Google, where Google had put their new 8 patients on the table.

As the news of Apple's CEO, Steve Jobs retiring is now slowely vanishing from Technology websites's front pages, it is being replacing by Apple's second attempt to stop the imports of Samsung's galaxy Tabs in Australia.

Samsung had created an "Australian version" of the tablet but once the new version of the tablet was seen by Apple, the company insisted that it still infringed their patients; although did not present any new evidence to support their claim. It looks like Apple is not letting ANY Samsung tablet from getting to Australia.

In 2006, LG teamed up with Prada, to create the LG KE850; now 5 years later the design is still considered modern.

The Prada phone was arguably the first full touch phone and one of the first 'smartphones' on the market. A year later Apple came out with the iPhone, a full touch-screen phone with a similar design and interface. Then in 2010, 4 years after the Prada phone came out, Apple released the iPhone 4; a direct look alike of the phone LG released back in 2006. Chrome around the sides of the phone, a horizontal speaker on the top of the phone and an almost featureless front and back, are just some of the similarities between the two.

Criticism arose when the iPhone was first released, with many online forums arguing the similarities between the two handsets. Weeks later LG accused Apple of copying the Prada phone's design and threatened to take legal action. When the iPhone 4 came out, their was no comparison between the two phones, but in fact Apple had taken another step to far, copying the LG Prada phone even more. Now after 1 year on the market Apple is suing Samsung, over the designs of their phones, being to similar to the iPhone's.

Does the iPhone 4 and the LG Prada phone look alike?

Yesterday, Steve jobs announced his resignation of Chef Executive Officer of Apple Inc. The news caused Apple's shares to drop by 7%, while Samsung and HTC's shares to jump by 3%. Some articles are suggesting that Jobs's departure was the direct result of the drop of shares and the reason for the rising of Samsung's shares, saying that investors believe that Jobs departure has "...Opened the door for rival Samsung Electronics at a crucial time in the battle for smartphone supremacy in salesrooms and courtrooms around the world".

I believe that Steve Jobs' resignation will have little effect in Samsung's sales, however due to the huge sales in their galaxy phone line, Samsung is already catching up to Apple and will likely overtake Apple in the smartphone race regardless.

Stanley Kubrick, and writer Arthur C. Clarke, can be credited with having 'invented' the iPad2 in their depiction of tablet-style devices in the film 2001: A Space Odyssey.

Samsung has recently offered an still image of a clip from Kubrick's film in its defence of a US ‘patent’ lawsuit brought against it by Apple. The clip depicts a tablet-like device being used by astronauts. While the astronauts are eating, they are receiving orders from their Captain through the screen. According to Samsung, if Apple cannot actually claim credit as the original designer of the slimline form of its iPad2, it cannot maintain a valid design patent registration.

If the court finds that the Space Odyssey tablets are sufficiently similar in appearance to Apple’s design, it will be of no advantage for Apple to object that the movie tablets are fictional. The props were most likely real – though, presumably, non-functional. If Apple cannot claim to be the original designer, the Court-case will be 'closed'.

Comparison between Samsung's Touch Wiz icons (top) and Apple's i0S icons (bottom).

As you can see from the from the comparison above, Samsung's Touch Wiz overlay on Galaxy S devices have icons that are very similar to the iPhones with the icons even being a similar shape.

This dosen't make it confusing to differentiate the two manufacturers phones apart, but the icons are just too similar. Once you look closely at the icons on both devices you can tell that this was no 'accident', the white phone in the middle of the "Phone" icon is at the exact same angle, and Samsung's music icon is almost exactly the same as the old iTunes icon. The rest of Samsung's Touch Wiz icons have a striking resemblance to the i0S icons.

Although I still don't believe that Samsung has "slavishly copied" Apple's design. If you want to see who "slavishly copied" Apple's Designs, I dare you to have a look at the comparison between the I'm watch and the iPod Nano.
After news that claimed Apple had invested $1 billion in the LCD maker, Sharp. It seemed to me as an indication that Apple was ready to sue LG (the supplier of the iPhone's screens). After-all Apple has been suing all the major Android manufactures. Plus as Sharp produces a number of android phones for AT&T, it seems even more likely that this is the case. Could LG be next on Apple's list?

As the Samsung- Apple lawsuit drags on, it makes it even harder to guess the outcome and will be the win. But after Apple's attempt of winning the lawsuit, manipulating photos of Samsung's devices, making them look the same shape of the iPhone and the iPad; it seems that this will give the South-Korean company a fighting chance.

A week after Google had acquired Motorola, It has been found that 18 of Motorola's 17,000 patients prove to be the most useful in Google's effort to fend off litigation (Apple) targeting the Android mobile platform. Seems like the Google's investemnt has payed off.

It has been made clear of the 44 page lawsuit that Apple filed against Samsung, That Apple has manipulated comparisons against the iPad and the Tab 10.1 making them seem more alike. The lawsuit against Apple and Samsung resulted to a hult in the shipment of Samsung products in Europe and Australia. This verdict was made after the Court had seen the manipulated comparisons Apple showed.

The comparisons included the Samsung Galaxy Tab and the iPhone and the Samsung Galaxy S, both Samsung devices were digitally shrunk or elongated to match the shape of the Apple products.
The images above show Apple's attempt to make the two products look similar, the company widened
and shrunk Samsung's tablet, used the screenshot of the "My Apps" screen instead of the homescreen
(what is showed on the iPad) and swapped the volume buttons to the left side of the device.

The image above shows the same story, Samsung device has been shrunk down to match the length
of the iPhone and the homescreen is not shown as it has no resemblance to Apple's.

Along with that Apple also gotten rid of the logo on the Tab to match the iPad's featureless front side.

Photo manipulation in an illegal act, looking at the pictures, Apple has clearly broken the law. Samsung would need to follow up on this, if they have any change of returning the Tab back to the European Market. Note that Samsung's CEO did mention the photo manipulation in court but did not have any evidence to support their claim. Now though, the Korean Manufacture can take action!

One more story for today, this one regarding a new potential iPhone competitor entering the smartphone market very soon. The world’s largest online business-to-business trading platform, the Alibaba Group announced that it had developed a mobile operating system, Aliyum and is already headed to the Chinese Markets. The Linux-based OS is able to run Android, applications, as well as being able to run HTML and Javascript. It has a "cloud-based" email, Web search, GPS and also can also store call data, text messages and photos in the cloud. The English version of the OS is expected to come out before the end of the year.

It seems very promising, having nearly the same capabilities of Android; but it seems to be quite late to enter the smartphone market now; especially that brings nothing new to the table. Plus now that Android is now being claimed by Apple for violating their patients theirs no doubt that Android's brother here will face the same stupidity.

Once you sign up for Hunch.com you are instantly greeted with 10 questions you much fill out, two of them asking your household income and what mobile platform you have running on your phone. This information has recently been compiled together and has showed some unexpected results.

Hunch created the survey from 15,000 members on their site, a site that gives you recommendations based on a few preferences, (eg. Type of car you drive). Note that the data was based on 32% iPhone users while only having 21% Android users, even though their are 10% more Android users that i0S users on the site.

The data claimed that Android users [on the site] are more likely to be men, with an annual household income around $75,000, while iPhone/i0S users were more likely to be women over the age of 35 and have an annual household income of around $200,000+. This is likely due to the fact that most Android phones being cheaper than iPhones despite the success of Samsung's popular galaxy line-up. It also says that 100% of Android users and likely to have a PC and 100% of iPhone users are likely to have a Mac. It also notes that android users are more likely to only have a High School diploma while iPhone users are 37% more likely to have a graduate degree.

Now that Google has acquired Motorola, some articles are speculating a wide range of different scenarios that will come of the agreement. Some Speculating that it won't work and bring Motorola to its knees while some are saying that other Android smartphone competitors better buckle up.

Now that Google has acquired Motorola what does this mean for other Android competitors? Some articles are suggesting that Google will give quicker updates to Motorola phones than other third party handsets or future releases of the platform could be more "tightly integrated" on the Motorola phones. These are likely possibilities but I doubt it, I think Google chose to buy Motorola to save Android, as some Big Android manufacturers are forced to drop out of the tablet and maybe smartphone market soon enough.

Kantar's ComTech WorldPanel has recently revealed that Android has overtaken i0S in Australia for the first time. If you calculate the last four weeks of smartphone sales in Oz you will see that a massive 54% of phones sold were android while 29% were Apple. So while Apple is suing everyone in the business, its being thrashed by them, one country by one. Lets see what milestones they will report in this Septembers Keynote.

Source(s):

Its is hard to escape Apple's craze for suing everyone in the mobile industry when its splashed across the front of every technology website their is. Is it working though?

As we know Apple has won the court-case with Samsung (the biggest Android manufacturer), not allowing Samsung to ship their Samsung Tab 10.1 in Europe and Australia, but is the effecting Smart-phone sales? I believe this could be effecting, not Samsung's sales but Apples. Their is an overwhelming amount of hate in the comments of quite a few of articles regarding the lawsuits, I'm not sure these people are just Android fans or bias in some way but the number of dislikes to likes speak for themselves. The example I gave included the comment: "Yes, apple should win and stop all selling of galaxy S devices in the world." This comment has gotten 68 'dislikes' and 11 'likes'. What does that tell you?

Google has recently bought the phone/tablet manufacturer, Motorola for $12.5 Billion; ($40 per share). So what is the reason for the multi-billion search engine buying a company like Motorola?

"We believe that their mobile business is on an upward trajectory and poised for explosive growth." - Larry Page, Google CEO and co-founder.

That may be true, but with an upcoming lawsuit with Apple coming very soon I find it hardly coincidental. Back in July, Eric Schmidt (Google's Executive Chairman) said this when asked about the HTC lawsuit against Apple: “We will make sure they don’t lose and win the court case". Clearly Google are willing to save their Android operating system, which seems to be the common aspect why Apple is accusing patient infringements for the major smart-phone companies.

Their has been a lot of media surrounding the so called "fake" Apple stores in China. These stores are not fake but do not have the right authority to sell the genuin Apple products.

"Displaying the Apple logo, the products are on tilted stands on wooden display tables, the employees are decked out in the familiar blue t-shirts with their name tags hanging from their necks, in fact the illusion is so convincing that even the staff are under the impression that they are working for Apple."

Their are some reports that the Employees working their actually thought they were working at a 'real' Apple store but somehow I doubt it. Apple has not responded to the stores in China but its obvious that they will soon, and probably a lawsuit as well [after the Motorolla and HTC lawsuits have passed].

Another lawsuit. This week has been full of them, while Apple is claiming patent infringements to every company that could be a potential iPad/iPhone contender; the companies are striking back  claiming the exact same thing.

This lawsuit involves the former band member of 'Pretty Boy Gangsters', Korvel Sutton. Who claims that iTunes has been selling ten compilation albums that include copyrighted tracks from Pretty Boy Gangsters. The tracks being sold without Sutton's permission and to this day he has not received any compensation nor royalties from the sales.

Representing himself in court, he introduces several pieces of evidence to the table including a copy of the U.S. copyright registration, a photocopy of "Rollin' like a Star" cassette tape, and a full list of compilation albums on iTunes that includes the copyrighted tracks. “2 Live Crew & Posse“, “West Coast Posse Vol. 1” and “Elektro Hip Hop Party Vol. 3”. Apple responds to this saying the disputed compilations were provided by the Dutch label, Rams Horn Records and do not respond to the 'missing' royalties.

Now the 'Most Valuable company in the world' is turning to Motorola and suing them for the exact same reason: patient infringements, more than 40 apparently. Apple and a group of book publishers were accused in a lawsuit today of illegally fixing e-book prices to "boost profits and force e-book rival Amazon to abandon its pro-consumer discount pricing." - CNET [AUGUST 9, 2011]

The Amazon kindle, [a hand-held device that displays digital books or e-books] was released in 2007, turning out to be a world-wide success, selling out in less than six hours. To gain market share, take advantage of its first-mover advantage, and capitalize on the tremendous efficiencies associated with eBooks, Amazon set eBook pricing levels significantly below prices for physical books."

Apple knew that if Amazon could establish the Kindle as the dominant eBook reader by reducing the value of e-books, Amazon could then use the Kindle platform (and its large installed user base) to distribute other digital media. Which would make Amazon a real contender against Apple's iTunes on their iPod, iPhone and iPad line.

To stop this, Apple conspired with HarperCollins Publishers, Hachette Book Group, Macmillan Publishers, Penguin Group, and Simon & Schuster to increase ebook prices. Introducing the "Agency model" which allows publishers set their own e-book prices, rather than the traditional wholesale model in which publishers set a retail price and retailers set their own sales price. In their attempt to stop Amazons $9.99 e-book price and Apple could smoothly enter the eBook market without having matching Amazons e-book cost.

"The Publisher Defendants and Apple implemented the unlawful agreement in January 2010, when five of the six major book publishers of fiction and nonfiction works almost simultaneously announced that they were switching from a wholesale pricing model to an Agency model for eBook sales."

iBooks (Apple's eBook store) was then released in late January along with the iPad, ("Apple's e-book reader").

Perfect 10: An adult website providing nude pictures of female models in different positions for a monthly suscription.

Recently the U.S. appeals court has rejected Perfect 10's (an adult website) claim of Google costing them $50 million million worth of suscriptions by displaying their images in google search results; violating copyrights and in the long run ruining Perfect 10. Some articles are suggesting that due free alternative pornography sites, people do not see the point of paying a monthly suscription for nude pictures when they can get it for nothing. This is probably the main reason for their fall but their pictures displaying on Google Images didn't really them help either. The court dismissed the case saying their was not enough evidence that proved that Perfect 10 had lost the sum of money due Google images. Plus the fact that the developer of the site did not know how to operate robot.txts files (a convention to prevent cooperating web crawlers (eg. Google) from accessing all or part of a website which is otherwise publicly viewable.

Apple may be the Biggest Smartphone maker but when you look how many phones run Android and how many phones run i0S its a whole different story. Android takes up a massive 40.1% of Smartphone market share while Apple makes up only 27%. The reason for this is simple, Android is an operating system used by multiple phone companies including: Samsung, LG, HTC, Motorola and Sony. So while Apple is the larget smartphone manufacturer, android phones are nearly doubly more popular.

Apple has recently gone on a 'suing spree' charging, Samsung, HTC, Motorola for infringing patients. After seeing apple's new ios 5 that included, a notification 'blind' that looks like Apple stole from android's mobile OS, a chat service which is sililar to Blackberry messenger and many other unoriginal features. Dosen't it seems very ironic that Apple is the one on the suing end of all this. So far apple has won a few lawsuits and slowly the android makers are shutting down; Amazon has stopped all submissions for its android Appstore in Germany and Samsung has halted their tablet sales in Australia.

Nokia phones have had an 'unsurprising' dip in the market, this dip accounts for the 47 percent loss in the Symbian handsets. Nokia's market share has dropped the most since, 1999. Despite the drop in market share, Nokia remains to be the Biggest handset manufacturer in the world. So whats the cause for this sharp drop in the market? I believe it is due to the symbian operating system running on them, a ticking time bomb that will discontinue at the end of this year, replacing with Windows Phone 7. Along with Nokia phones being quite thick and with the competition of iphones, windows phones and a wide selection of android phones, nokia dosen't really have a chance. Nokia stands 3rd just behind samsung, whose Galaxy line-up has proven very successful.

Just a few weeks ago I went to the cinemas along with some co-workers to watch Transformers 3, we were going to see it in the 3D but because one of my mates has glasses we weren't really sure if he could wear them with the 3D glasses and actually see the movie. Anyway, so we altered to 2D version. We were slightly late arriving to the cinema but to our surprise no one was there, the movie suddenly starts and we sit down. We turn out to be the only ones watching the movie in 2D at that particular time. Which makes we wonder was everyone watching the 3D version? I mean is it that popular?

When I logged on youtube it looked like it always did, but when I went on a video the bar below the video used to pause, forward and rewind were black. I think looks much better than the very dull grey and now that I think about it looked quite outdated. This is part of the new cosmic Panda update which is currently unreleased but you can try it out here. If you want to change to the old version just go to the same link and find the words "Older version" and click it.

Staying on google, the NEW google plus has now reached 10 million users. Which is quite large bearing the fact that to be a user on the new social network you need an invite which you can give when you are a member. I have not tried Google Plus but with the Competition of the huge Facebook and Myspace currently being exhumed from its grave.

The Google Chrome webstore started on the 7th of December, back then the store only consisted of a few minor apps but now the store is jam-packed full of games and applications. Just recently Rovio has put Angry Birds on the store so Google Chrome users can play the game for free online or offline. The Google Chrome store also supplies applications such as photo editors and weather forecasts in your browser, it and a lot more tools that make your browsing experience, much easier, much better.

Just recently Myspace has been sold for $35 million, so who bought it? Justin Timberlake. Yes, the music artist. He along with another unknown major corporation will be trying to bring back the "cool" in Myspace. You might think that $35 million is a lot but compared to it's major competition, Facebook; which has a net worth of $50 BILLION.

I begin by asking why Apple would roll out an OS so late after it was announced and why everyone is so damn excited. The recent keynote, showed Apple sink to new lows, as they desperately label all features of the new OS has 'revolutionary' in a bid to successfully generate applaud from the audience who consist of desperate reporters and Apple fanatics, who clapped eagerly at every moment. Unfortunately the truth is that a majority of the features introduced weren't 'revolutionary' but either a lift from Google's Android or the jailbreak community.

After Amazon and Google had rolled out their cloud services months ago it was inevitable that Apple would join the market, WWDC saw Apple's take on cloud service, the ingeniously titled, iCloud. This didn't really bother me, considering Apple fanatics have already admitted that Apple 'makes existing ideas better,' so I dismissed it, until they started to announce the new features of iOS 5. Notification centre - a clear rip off of the android blind angered me, as the thousand person audience clapped with excitement.

WifiSync is another thing that is unoriginal, Apple got the idea (or even the software) from Greg Hughes who has trying to get his WifiSync in the app store, quite a while ago.

iMessage, a way i0s5 users can send other people text, photos and videos over wifi. This is apple's version of Blackberry messenger, this is probably the only feature in i0S 5 I could see myself using.

Reminders: "A better way to do to-dos."
When I firstly found about this I was really disappointed in Apple. As their are very similar apps to this in the app store. I feel sorry for the developers who have similar apps on the App store, at least the remaining i0S devices not receiving the update have an alternative.

Application short-cut on the lock screen this being the camera. Now the new HTC sensation had been reased before te keynote and that includes application short cuts on the lock screen as well. I'm not really sure I should include this, as it's not really copying.

I believe all of the above and more make the new i0S unoriginal and unappealing.

 "White Gimme SBsettings theme"

Note that this article was written back in 2011, when Apple didn't introduce the notification centre. Which brings me back to the point of why I am re uploading this, it was the first tweak I had created. Well not really, I stole it and changed it to white, yeah how creative of me.

There was a small change on Facebook this morning, the "Post" button was missing. The last big change that Facebook did was when they changed your profile layout. I hated it along with majority of Facebook users but did it get changed back or did we get a choice to alter to the old one? No. There was even a group called "I hate the New Facebook Profile", having 14,000 people join you would think Facebook would get the message! Now they have gotten rid of the post button, and replaced it with the Enter Key. Now you are able to start a new line pressing Shift+Enter, but why should you? Seriously what was wrong with a button? Facebook it says it's only testing this feature but I bet that it well never be changed. There is some good with this change though, you can edit posts. So before if you spelt something wrong or said something you didn't want to say, you would have to delete the comment and write another but now instead you can click the "X" button of the left of your post and you can edit it and repost!

After hearing about the struggles that are happening in Japan I go into Safari noticing a red emblem at the bottom of the apple site, I click on it and sure enough apple is hosting a donation to victims in Japan. I looked very closely to the text it gave me next searching for the percentage, remembering, Apple's new subscriptions. Sure enough it said "iTunes will transfer 100% of your donation to the American Red Cross."

Good Work Apple!

Yesterday Apple a held press conference introducing the highly anticipated iPad 2, caused by new tablets being announced from Blackberry, HP, Samsung, HTC and other big manufacturers last month. The New iPad will include 2 cameras, One in the front for face-time and another on the back for taking photos and video on.

They also announced an "awesome" iPad cover claiming that the old one made the slick iPad too thick. The new cover is ultra thin and uses magnets to stick it's self to the iPad, but does not cover the whole iPad but just the screen. Now this isn't a screen protecter as it's not transparent, it's more like a pointless accessory, that you'll probably get board with in the first few days after purchasing it. Anyway, that was probably the highlight of the Apple's Press conference as well as the iPad shipping in white on Day One.

Today Apple's App Store started their subscription service (for magazines and newspapers including The Daily). I won't be really using this service but the reason I put this on my blog that Apple is taking a massive 30 percent cut of each subscription. And it's not letting publishes charge more to cover those costs. Now if we compare this to Google's Subscription Plan, One Pass, Which coincidently was introduced on the same day as Apple's. Google is only taking 10%.

To ensure they get their cut, Apple has banned apps from linking to other subscription methods like the publisher’s website. Apple is also refusing share the details of those customers with the developer.

"In Australia, publishers have had their iTunes apps rejected for exploiting loopholes that allow them to sell subscriptions and accept payments without giving a share to Apple. Sometimes apps are rejected without an explanation."

So, No Cut. No Subscription.
